Errors & Omissions

Zatorie.com assumes no responsibility or liability for any errors, omissions, or accuracy of information or within the content of information obtained from its customers and used for your end product, including but not limited to dates, addresses, typos, and misinformation.  All customers must responsibly and thoroughly inspect their final proof before approval.  Any errors or omissions will not be Zatorie’s responsibility.  Zatorie.com does not recommend dates or timelines to be used, customers must calculate accordingly. 

 

Approval of Proof

Customers will receive a designated designer which will provide proofs of their design product.  Upon which a customer will receive a final proof, by responding with a written email approval of the final proof, customers are approving design and content of each product and agreeing to move forward with production of product.  Customers should rigorously inspect their design and content before approval.  Customers approving final proofs understand that changes cannot be rendered beyond this point.  In the event of a change being necessary after a customer’s written email approval of final proof, a change may not be granted and Zatorie will not be held liable.

 

Chronology

Timeline for approval of final proof is based upon number of modifications made as well as complexity of alterations.  Zatorie cannot forecast the allotted time for this process as each order requires a unique amount of rounds/time for amendments to occur.  Upon customer granting approval of final proof (and rigorously assuring content is accurate), Zatorie will begin production of items which could take up to 15 business days (historically the average time for completion is 10 business days) to leave our factory and this timeline and does not include shipping time.  Customers should consider timeline needed for receipt of products when ordering and cannot hold Zatorie liable for any miscalculations.

 

Satisfaction

Should you receive your product and are dissatisfied with manufactured goods, Zatorie will provide a full refund upon receipt of returned product.  While Zatorie strives for 100% Satisfaction, the following causes are not eligible for refunds: Event Cancellations, Natural Disasters, Pandemics, Venue Changes, Date Changes, Address Changes, Postponement, Acts of God, or any other circumstances which lie outside of the control of the company. 

 

Shipping

Zatorie strives ensure delivery of items in a timely manner.  Third party delivery services are used for shipping, and responsibility of delivery solely lies on chosen shipping company to deliver your items.  It is beyond Zatorie’s control should there bean interruption or delay in a delivery due to assigneddistribution company experiencing any type of interruption or postponement of delivery.   If there should be an issue with the shipping provider, we advise customers to contact shipping providers directly.  If for any reason a shipping company has delayed shipment and not delivered items on time, Zatorie is indemnified from any responsibility.  In the case that a delivery is sent outside of the 15 business day period, which is estimated for shipment sent, then a customer is entitled to a refund.  Ground deliveries may take up to 7 business days.  If a customer should need an item in shorter amount of time, Zatorie is not responsible for the miscalculation of typical shipping times.  Upgrade options are available to ship sooner, and customer assumes responsibility of calculating properly which shipping times is appropriate for the needed delivery date of items.  Customers cannot request a refund if there is a successful delivery in an appropriate time, but the customer failed to take into account the correct shipping times, is unavailable for delivery, has provided inaccurate shipping address, or any situation which may delay or return the shipment.  For customers which use address services from Zatorie, customer assumes responsibility of providing accurate mailing addresses.  Any items returned undelivered will not fall underZatorie’s liability.

 

Content

Zatorie is full owner of all proofs provided to customers.  A customer may not redistribute, print, or reuse any art work provided to customers.  All artwork/proofs provided is the sole property of Zatorie, any customers which use artwork/proof provided is lawfully responsible and will face legal  action.

 

Limitation of Liability

In no event shall we or our affiliates be liable to you or any third party for any special, punitive, incidental, indirect or consequential damages of any kind, or any damages whatsoever, including, without limitation, those resulting from loss of use, data or profits, whether or not we have been advised of the possibility of such damages, and on any theory of liability, arising out of or in connection with the use of this site, its products, or of any web site referenced or linked to from this site.

Further, we shall not be liable in any way for third party goods and services offered through this site or for assistance in conducting commercial transactions through this site, including without limitation the processing of orders.

Some jurisdictions prohibit the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you.

 

Indemnification

Upon a request by us, you agree to defend, indemnify, and hold us and our Affiliates harmless from all liabilities, claims, and expenses, including attorney’s fees, that arise from your use or misuse of this site. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.
